Welcome to OakThreadLoom ("we," "our," or "us"). These Terms & Conditions ("Terms") govern your use of our yacht charter services and website located at oakthreadloom.sbs (the "Service") operated by OakThreadLoom.
If you choose to book a charter or use our Service, you are agreeing to be bound by these Terms. Should you not agree with any section of these terms, you are not permitted to access the Service.
2. Service Overview
OakThreadLoom offers luxury yacht chartering services, which include:
- Yacht rentals for the day
- Sunset voyages
- Business retreats
- Exclusive gatherings
- Prolonged charters over several days
Our services are offered based on vessel availability and weather conditions. We hold the right to alter or cease services without notice at our discretion.
3. Booking and Reservations
3.1 Booking Process
To arrange for a charter, you must fulfill the following criteria:
- Be at least 18 years old
- Supply precise and comprehensive information
- Make the necessary deposit as indicated in your booking acknowledgment
- Consent to these Terms & Conditions
3.2 Confirmation
A confirmed booking is dependent on the completion of payment and our subsequent written acknowledgement. We have the authority to refuse service to anyone at our own discretion.
3.3 Availability
The availability of charters hinges upon the accessibility of the vessel and favorable weather conditions. We strive to accommodate your preferences for dates and times where feasible.
4. Payment Terms
4.1 Pricing
All fees are provided in € and include taxes when applicable, unless specified otherwise. Prices can be subject to modifications without prior notification.
4.2 Payment Schedule
- A deposit amounting to 50% of the whole charter cost is due when booking
- The remaining balance: To be paid 48 hours prior to the charter's departure
- Extra fees (if applicable): To be settled post-completion of the charter
4.3 Payment Methods
Major credit cards, bank wire transactions, and authenticated cheques are accepted. Our secure, encrypted systems handle all payment processing.
5. Cancellation and Refund Policy
5.1 Customer Cancellations
- If cancelled more than 72 hours prior to departure: Full refund excluding processing charges
- For cancellations made 24-72 hours in advance: 50% of the payment will be refunded
- Cancellation less than 24 hours before departure: Non-refundable
5.2 Weather Cancellations
In instances where our captain deems the weather unsafe, we propose the following:
- Reschedule your charter at no additional cost to the next available slot
- Grant a full refund should rescheduling be impossible
5.3 Mechanical Issues
Should there be mechanical issues with your specific vessel, we will aim to provide a comparable substitute. If no alternative can be offered, we shall issue a full refund.
6. Safety and Conduct
6.1 Safety Requirements
All travelers are required to:
- Abide by all directions given by the crew
- Use provided safety gear as needed
- Declare any health conditions that could impact their safety
- Stay within approved areas of the yacht
6.2 Prohibited Objects
The following items are prohibited on the yacht:
- Glass vessels
- Illegal substances
- Weapons or any form of weaponry
- Excess non-alcoholic beverages beyond reasonable amounts for personal consumption
- Pets (unless given prior authorization)
6.3 Behavior
Passengers are expected to behave in a manner that is considerate and respectful. Should a passenger's behavior present a risk to safety or interfere negatively with other's experiences, we maintain the right to end the charter prematurely and without refund.
7. Liability and Insurance
7.1 Our Responsibility
We are liable only to the extent of the charter cost paid. We hold no responsibility for:
- Injuries sustained due to the negligence of passengers
- The loss or destruction of personal belongings
- Indirect or consequential losses, or punitive damages
- Delays prompted by weather or situations out of our control
7.2 Insurance Policy
Insurance that is comprehensive and covers our vessels and operations is maintained by us. It's the passenger's duty to arrange for their personal and travel insurance.
7.3 Acceptance of Risk
Participating in our yacht chartering services signifies that you comprehend the inherent risks associated with sea activities and that you accept responsibility for your personal safety and security.
8. Modifications and Itinerary Adjustments
Based on considerations for safety, changes in weather, or operational needs, we reserve the right to modify routes, itineraries, or schedules. Every effort will be made to ensure an experience comparable to the planned itinerary.
9. Uncontrollable Events
Obligations hindered by circumstances outside our control, which may include, but are not limited to, are not our liability:
- Severe meteorological conditions
- Natural catastrophes
- Mandates issued by authorities
- Shutdowns of harbors
- Vessel malfunctions
10. Privacy and Protection of Data
Your private details are managed in accordance with our Privacy Policy. Utilizing our service implies your endorsement of the data collection and utilization laid out in our Privacy Policy.
11. Ownership of Intellectual Property
Our website's content, including but not limited to, written text, imagery, graphics, and logos, is safeguarded by copyright and trademark laws. You are not permitted to replicate, disseminate or create derivative works without our direct written consent.
12. Legal Governance
The legal jurisdiction of Germany governs these Terms, with legal disputes to be resolved within the courts of Hamburg, Germany.
13. Revisions to Terms
We may alter these Terms as needed. Updates will appear on our website with the corresponding revision date noted. Continued use of our services after changes have been made reflects your acceptance of those changes.
